LEGAL NOTICE AND ACCEPTANCE

The present legal notice regulates the use of the service of the Internet portal www.devicare.com (hereinafter the "Portal") that DEVICARE (hereinafter "THE OWNER") makes available to Internet users.

The use of the Portal attributes the condition of user of the Portal (hereinafter, the "User") and implies the full and unreserved acceptance of each and every one of the provisions included in this Legal Notice.

Consequently, the User must read this Legal Notice carefully each time he/she intends to use the Portal, as it may undergo modifications.

THE OWNER reserves the right to unilaterally modify, at any time and without prior notice, the presentation and configuration of the Portal, as well as the Services and the conditions required to use them.

CONDITIONS OF ACCESS AND USE OF THE PORTAL

3.1. Truthfulness of the information

All information provided by the User through contact forms must be truthful. To this end, the User guarantees the authenticity of all data provided.

Similarly, it shall be the responsibility of the User to keep all information provided to the OWNER permanently updated so that it corresponds, at all times, to the real situation of the User. In any case, the User shall be solely responsible for any false or inaccurate statements made and for any damages caused to the OWNER or to third parties as a result of the information provided.

3.2. Obligation to make proper use of the Portal and the Services

The User undertakes to use the Portal and the Services in accordance with the law, this Legal Notice, and other notices, regulations for use and instructions made known to them, as well as with generally accepted morals and good customs and public order.

To this end, the User undertakes to refrain from using any of the Services for illicit purposes or effects, prohibited in this Legal Notice, harmful to the rights and interests of third parties, or which in any way may damage, render useless, overload, deteriorate or impede the normal use of the Services, computer equipment or documents, files and all types of content stored on any computer equipment belonging to THE OWNER, other Users or any Internet user.

All industrial and intellectual property rights of the website, as well as of the elements contained therein (including, among others, images, texts, etc.) belong to THE OWNER.

3.3. Liability for damages and losses 

The User shall be liable for damages of any kind that THE OWNER may suffer, directly or indirectly as a result of breach of any of the obligations arising from the Legal Notice or the law in relation to the use of the Portal and, in particular, undertakes to refrain from: 

(a) reproducing, copying, distributing, making available or in any other way publicly communicating, transforming or modifying the Contents, unless authorised by the owner of the corresponding rights or this is legally permitted. 

(b) delete, manipulate or in any way alter the copyright and other data identifying the rights reserved by THE OWNER or its owners, the digital fingerprints or any other technical means established for their recognition. 

The User must refrain from obtaining or even attempting to obtain the Contents by using means or procedures other than those which, as the case may be, have been made available for this purpose or have been indicated for this purpose on the web pages where the Contents are located or, in general, those which are normally used on the Internet for this purpose, provided that they do not entail a risk of damage or disablement of the Portal, the Services and/or the Contents. 

3.4. Introduction of hyperlinks that allow access to the pages of the Portal and the Services. 

Users and, in general, those persons who intend to establish a hyperlink between their web page and the Portal (hereinafter, the "Hyperlink") must comply with the following conditions: 

(a) no false, inaccurate or incorrect statements or indications shall be made about THE OWNER, its employees, the web pages of the Portal and the Services provided;

 (b) it shall not be stated or implied that THE OWNER has authorised the Hyperlink or that it has supervised or assumed in any way the services offered or places at the disposal of the web page on which the Hyperlink is established; 

(c) the web page on which the Hyperlink is established shall not contain information or content that is illicit, contrary to morality and generally accepted good customs and public order, nor shall it contain content that is contrary to the rights of third parties. 

The establishment of the Hyperlink in no case implies the existence of a relationship between THE OWNER and the owner of the website on which it is established, nor the acceptance and approval by THE OWNER of its contents or services. 

NO LICENCE 

All trademarks, trade names or distinctive signs of any kind that appear on the Portal, as well as the contents, are the property of THE OWNER, and it may not be understood that the use of or access to the Portal grants the User any right over the aforementioned trademarks, trade names and/or distinctive signs and contents. 

JURISDICTION AND APPLICABLE LAW 

The Rules of Use contained in this Legal Agreement are governed by Spanish Law. Both THE OWNER and the users of the Site agree that for any discrepancy that may arise regarding the interpretation, compliance and/or execution of these rules, they will expressly submit to the jurisdiction of the competent Judges and Courts of the domicile of THE OWNER, expressly waiving any other jurisdiction that may correspond to them.
